This document (the “Agreement”) outlines the principles, guidelines, and conditions of the Terms of Service for our primary company, israelservers.com, and its affiliated consulting branch, Onlive Server Pvt Ltd. (the “Company”). These terms govern the use of the Company’s services and products (“Services and Products”) by the customer (“Customer”). These Terms of Service have been established to ensure the integrity, security, reliability, and privacy of the Company’s infrastructure, network, and the Customer’s data. The Company is committed to providing industry-leading services and has implemented the following policies in the best interests of the Company and its clients. The Company reserves the right to modify these Terms of Service at any time. Any modifications will automatically apply to all customers when adopted and published by the Company, and the Company will have the final say on interpreting the terms. By using the Company’s services and products, the Customer agrees to abide by the terms outlined here.

Compliance with the Law

The Customer is prohibited from posting, transmitting, or storing material on or through the Company’s services that, in the Company’s sole judgment, (i) violates any local, state, or federal laws or regulations, (ii) is offensive, obscene, defamatory, or harmful to others (“Persons”), or (iii) violates any person’s rights, including intellectual property rights like copyrights, patents, or trade secrets. The Customer agrees to indemnify the Company against any claims resulting from their use of the services that harm the Customer or any other party. The Customer is responsible for determining the laws that apply to their use of the services and products.

Prohibited Uses of Services and Products

Customers may only use the services for their intended purpose. If a Customer is uncertain whether a specific use is allowed, they should contact the Company. Below are examples of prohibited uses of the services and products:

1. General

Israel Server Hosting strictly prohibits the use of pornography or any related content under all its services. This includes websites that link to other pornographic materials. Other prohibited content and activities include gaming rooms, MUDs, IRC Bots, IRC, Egg Drop programs, “hacker” tools, anonymous or public proxies, proxy services, archives of “warez sites,” illegal software, shareware, or pirated software. Israel Server Hosting does not allow websites offering online gambling, casino games, offshore sportsbook betting, or online lotteries.

Installing or distributing pirated software or any unlicensed software products violates intellectual property laws, including copyrights, trade secrets, patents, and other applicable regulations. Hosting or using websites related to online booking systems, government-related services, IRCTC, or finance-related platforms on our servers, whether locally or online, constitutes a breach of these terms. If deemed necessary, we may take legal action and will not provide refunds. Israel Server Hosting prohibits actions that restrict or inhibit any person, including other customers, from using or enjoying its services.

2. System and Network

  • Introducing malicious programs (e.g., viruses, worms) into Israel Server Hosting’s network or servers is prohibited. This includes security breaches, such as unauthorized access to data or accounts. Disruptive actions like port scans, flood pings, or packet spoofing are also forbidden.
  • Any network monitoring that intercepts data not meant for the Customer’s server, or attempts to bypass security measures, is prohibited. Denial of service attacks or interfering with other users’ services is not allowed. Additionally, using artificial means to maintain an active connection on a Israel Server Hosting account is a violation.
  • Tampering with the Company’s monitoring or modifying log files is not allowed. Any action that negatively affects the Company’s operations may lead to account termination.
  • IP geolocation data accuracy can vary between providers. Israel Server Hosting uses Maxmind, IPIP, and IP2Location, and other providers may not have up-to-date or accurate data.

3. Mail

  • Sending unsolicited commercial emails (UCE), including “junk mail” or advertising to individuals who did not request it, are prohibited. This includes sending UCE referencing an email address, domain, or IP hosted by Israel Server Hosting or posting ads on public chat systems containing such details. The Company will determine violations of these terms.
  • Harassment through language, message frequency, or size, as well as unauthorized use or forgery of mail header information, is prohibited. Israel Server Hosting does not open Port 25 for general use unless specifically required for bulk mailing under agreed conditions.
  • Soliciting mail for other email addresses with the intent to harass, creating or forwarding chain letters or pyramid schemes, and using unsolicited email to advertise services hosted by the Company are also prohibited.
  • A $300 service charge will be applied for each verified UCE incident, with immediate account suspension and possible termination, along with additional penalties.

4. Customer Support

Israel Server Hosting fosters a professional and respectful relationship with its customers. Any abusive, threatening, obscene, or harassing communication with Company agents, whether via telephone, email, online chat, or other methods, will result in immediate account termination, regardless of other terms in this agreement. Violating this or any section of this Agreement will make the customer ineligible for refunds. Israel Server Hosting strictly prohibits abusive or derogatory comments related to religion, community, gender, or any other sensitive subject. If the Company detects such activities on its servers, it will terminate the service immediately without prior notice or any refund or credit. Additionally, the responsible party must provide clarification if requested.
Payment Gateway Fees: All international payment gateways, Indian payment gateways, PayPal, and other payment systems will incur associated fees. The user must cover these fees, either partially or in full. Bank transfers are exempt from this policy. Payment and Tax Credit Policy for Israeli and UAE Users.

5. Indian Users (israelservers.com)

Israel Server Hosting will generate invoices for users registered in India, including an 18% GST. You must make payments directly to Onlive Server Pvt. Ltd.. to qualify for GST credit. India bank account or via an Indian payment method, such as UPI, Debit Card, or Credit Card through an Indian Payment Gateway. The payment must originate from an Indian bank account and be in the name of the company claiming the GST credit.

6. UAE Users

Currently, VAT is not applicable due to the absence of a VAT registration number. However, VAT will be applied once registration is completed. To receive VAT credit when introduced, UAE users must make payments from a UAE-based account via an International Payment Gateway like Stripe, PayPal, or through bank account transfers to Israel Server Hosting.

7. User Responsibility:

It is the user’s responsibility to verify the company name and applicable tax amount when placing orders. Accurate details are necessary to qualify for tax credits. If there is any error in the order or registration details, users must notify us within 12 hours via a support ticket. Failure to do so will prevent invoice updates and may result in the loss of tax credits. Israel Server Hosting is not responsible for such user errors. This policy ensures that tax credits are granted only when payments comply with the specific requirements for each jurisdiction. Please make payments accordingly to take advantage of tax credits.

Payment Verification and Email ID Policy

PayPal Payments:

If a payment is made via PayPal from an email address different from the one registered in the client area, the user must provide an explanation for this discrepancy. This helps maintain consistency and security in our records.

Purchasing for Another Person:

If a user purchases services on behalf of another individual, they must provide proof of authorization. This should be an email from the person whose email ID is used for the payment, granting permission for the purchase. The email must be sent to [email protected].

If a user uses another person’s account to make a payment for their own service, they must obtain authorization from the account holder. An authorization email must be sent from the payee’s account email ID to [email protected]. Failure to provide this authorization will result in ineligibility to receive the service, as well as any refunds or credits under our policy.

Non-Compliance: If the above conditions are not met, services will not be activated. Additionally, the user will not be eligible for any refunds or credits. This policy is implemented to prevent unauthorized transactions and ensure all payments are properly documented and authorized.

Indemnification of Provider/Relationship of Parties

  • The Customer agrees to indemnify and hold Israel Server Hosting harmless from any lawsuit, claim, charge, or expense, including reasonable attorney fees and defense costs, arising from or related to the Customer’s Website provided under this agreement.
  • Nothing in this Agreement shall be construed as creating a partnership, joint venture, or any other relationship between the Company and the Customer. Both parties acknowledge that Israel Server Hosting does not interact with the data or content of the Customer’s Website, except as necessary for maintenance purposes.

Security/Software

  • The Customer agrees to take reasonable steps to protect their login credentials and not harm any server, software, system, or customer of Israel Server Hosting.
  • The Customer is responsible for maintaining their equipment, including running antivirus software. Uploading a virus to the server will result in account termination, service charges, and/or legal action.
  • Israel Server Hosting provides technical support only for its hosting services and initial configuration. The Company determines what constitutes a “hosting” issue.

Limitation and Exclusion of Liability

In no event shall Israel Server Hosting have any liability for damage, unauthorized access, alteration, theft, or destruction of information provided to the company, distributed, or made available via its services. Israel Server Hosting and its affiliated branches will not be liable for consequential, exemplary, special, incidental, or punitive damages, even if informed of the possibility of such damages.

In any case, the liability of the company to you, for any reason or cause of action, shall be limited to the amount actually paid by you under this agreement in the thirty (30) days immediately preceding the claim. This limitation applies to all causes of action, including breach of contract, negligence, misrepresentations, and other torts. The service fees under this agreement have been set based on this risk allocation.

Since some jurisdictions do not permit the exclusion or limitation of liability for consequential or incidental damages, in those areas, our liability will be limited to the maximum extent allowed by law.

Interruption of Service: You acknowledge and agree that Israel Server Hosting will not be liable for any temporary delays, outages, or interruptions of services. The company will also not be responsible for any delay or failure to perform its obligations under this Agreement if such delay or failure is caused by factors beyond its reasonable control, including, but not limited to, acts of God, mechanical, electronic, communication failures, or third-party supplier issues.

Maintenance: You acknowledge and agree that Israel Server Hosting reserves the right to temporarily suspend services for system and network maintenance, repair, or upgrades. While the company will make efforts to notify you of scheduled maintenance, there is no obligation to provide such notifications.

Backups and Data Loss: Your use of Israel Server Hosting’s servers and services is at your own risk. The company is not responsible for any files or data on your server. While the Company may provide backup services, it is your responsibility to maintain backups of your data and ensure its safety.

Violation: Any attempt to compromise or harm Israel Server Hosting servers or another customer’s web presence is strictly prohibited. Violation of these terms may result in account termination with no refund. Israel Server Hosting reserves the right to remove any account without notice. Such violations may also lead to legal action or service charges.

If any customer is disrespectful or abusive toward the company’s staff, we have the right to terminate their services without refund.

Confidentiality

The Customer acknowledges that, due to their relationship with Israel Server Hosting, both the Customer and the Company may have access to confidential products, information, and materials related to each other’s business, including business plans, customer data, software technology, and marketing strategies, which hold significant value. This value would be compromised if such information were disclosed to third parties. Therefore, both the Company and the Customer agree not to use, for their own benefit or for any third party, or disclose to any third party, any such confidential information shared by either party.

Both the Customer and Israel Server Hosting agree to take all necessary precautions to protect the confidentiality of such information. In the event of termination of this agreement, neither party shall use or disclose any confidential information in its possession. All confidential documents must be returned to the rightful owner or destroyed. The provisions of this section will remain in effect even after the termination of the agreement for any reason. In case of a breach or potential breach of this section, either party is entitled to seek injunctive relief, which will not be contested by either the Customer or the Company.

Disclaimer

The use of Israel Server Hosting’s services and products is at the Customer’s sole risk. Neither the Company, its employees, agents, resellers, third-party information providers, merchants, licensors, or affiliates make any warranties, including implied warranties of merchantability or fitness for a particular purpose. The Company does not guarantee that its services and products will be uninterrupted or error-free, nor does it warranty the results from using its services or the accuracy or reliability of any information, service, or product provided through its services, unless explicitly stated in this agreement. This includes data loss, whether caused by delays, delivery errors, or service interruptions from the Company, its employees, or other factors.

Refund and Cancellation Policy

  • HTTP injector is strictly prohibited on any of Israel Server Hosting’s services. If detected, the service will be canceled, and the user will not be eligible for a refund.
  • All dedicated servers will be delivered within 3 to 5 working days, although delivery may take longer in some cases. The billing cycle will be adjusted accordingly.
  • If a cancellation request is made within 7 working days, the user will not be eligible for a refund or credit, as Israel Server Hosting does not offer a refund or credit-back guarantee for dedicated servers.

Refund Policy

  • All refunds are at the sole discretion of Israel Server Hosting, including fees associated with primary services, additional features, and any setup charges previously incurred.
  • Spamming and bulk mailing are strictly prohibited on all services, except for bulk mailing servers.
  • Linux OS: None of the available Linux OS versions come with a GUI (Graphical User Interface), including all versions of Ubuntu, which are provided in a non-GUI form only.
  • Windows OS: Only the Windows OS comes with a GUI, enabling RDP (Remote Desktop Protocol) access.
  • Our refund or credit-back policy does not cover the availability or functionality of the GUI for any OS.
  • If any user engages in suspicious activities, their service will be suspended or terminated, and the service will not be recoverable. It is the user’s sole responsibility to monitor the use of their service, and such users will not be eligible for refunds.
  • No refund or credit-back policy applies to renewal payments, regardless of whether the payment is made before or after the service due date.
  • None of our servers support IPv6.
  • Customers on the Basic Plan can add two addon IPs, while Premium and Enterprise Plans can add up to three. The Starter Plan does not offer addon IPs. Due to limited availability of IPs, customers must provide a valid reason for requesting addon IPs.
  • Once an order is placed, it cannot be changed. If the customer wants to change the location of the order, they will need to pay the additional charge and will not be eligible for the credit-back policy.
  • Changes to the order are only possible with a valid reason and if the IP pool permits.

Cancellation

Israel Server Hosting reserves the right to terminate client services at any time. No reimbursement will be provided if services are discontinued due to a violation of the policy. Customers may use the client site or email to cancel their purchase and services according to the terms of their contract or service level agreement. They may also choose to cancel their order at the end of the billing period.

If a client violates the terms of service or refuses to pay after receiving the bills, Israel Server Hosting will promptly cancel the account without prior notice or alerts.

Israel Server Hosting reserves the exclusive right to delete all customer data associated with its hosting services without prior notice if an account is suspended or canceled due to reasons other than nonpayment. Cancellation requests must be submitted through the Israel Server Hosting Client area. To do so, visit the official website and select “Request Service Cancellation.”
